1. Introduction

These Terms and Conditions (“Agreement”) govern your use of internet services provided by Humbahost SA (“Humbahost”, “we”, “us”, or “our”). By using our services, you agree to comply with these Terms in accordance with the Electronic Communications and Transactions Act (ECTA) and the Consumer Protection Act (CPA) of South Africa.


2. Service Description

2.1 Humbahost SA provides month-to-month internet access and related services.
2.2 No fixed contract term is required unless explicitly stated otherwise.
2.3 All services are subject to availability of coverage, infrastructure, and third-party provider network quality.
2.4 Services are provided on a best-effort basis and are not guaranteed to be uninterrupted or error-free.


3. Account Registration and Client Responsibilities

3.1 You agree to provide accurate and up-to-date personal or business information when registering.
3.2 You are responsible for maintaining the confidentiality of your account credentials.
3.3 Any activity performed using your account will be considered your responsibility.


4. Billing and Payment Terms

4.1 Services are billed monthly in advance.
4.2 Payments are due by the 1st of each month.
4.3 Non-payment may result in suspension or termination of services without further notice.
4.4 A reconnection fee may apply if service is suspended due to non-payment.
4.5 All prices include VAT unless otherwise stated.


5. Cancellations

5.1 Services are cancellable on a month-to-month basis with a 30-day written notice submitted to info@humbahost.co.za.
5.2 Billing continues until the end of the 30-day notice period regardless of service usage.
5.3 Early termination of any promotional or subsidised plan may incur additional charges.


6. Equipment (Router) Policy

6.1 Humbahost may provide a router or other customer premises equipment (CPE) on loan or as part of a promotion.
6.2 The equipment remains Humbahost property unless otherwise agreed in writing.
6.3 Clients must return the equipment within 20 working days of the cancellation notice period ending.
6.4 Equipment must be returned via trackable courier at the client’s expense.
6.5 Failure to return equipment within the specified timeframe will result in a charge for the full replacement value of the equipment.
6.6 If equipment is returned damaged or non-functional due to negligence, the client will be liable for replacement costs.


7. Service Performance and Fair Usage

7.1 Service speeds and quality may vary depending on line-of-sight, infrastructure, and third-party conditions.
7.2 Humbahost may implement Fair Usage Policies (FUP) in line with standard South African ISP practices to ensure equitable bandwidth distribution.
7.3 Abusive usage, including excessive downloads, streaming, or bandwidth hogging, may result in throttling or suspension of service.


8. Acceptable Use Policy

8.1 The client agrees not to use the service for unlawful activities, including:

  • Hosting or distributing illegal content
  • Sending spam or malware
  • Network abuse, including DDOS or scanning
    8.2 Violation of these terms may result in immediate termination without refund.

9. Regulatory Compliance

9.1 Humbahost complies with the regulatory requirements of the Independent Communications Authority of South Africa (ICASA).
9.2 All clients are expected to use services in compliance with South African laws, including the RICA Act (Regulation of Interception of Communications).


10. Privacy and Data Handling

10.1 We are committed to protecting your personal data and handling it in accordance with the Protection of Personal Information Act (POPIA).
10.2 By using our services, you consent to us storing and processing your personal data for billing, support, and service delivery.


11. Limitation of Liability

11.1 Humbahost shall not be liable for damages resulting from:

  • Service interruptions
  • Data loss
  • Equipment failure
    11.2 Our total liability shall not exceed one month’s service fee.

12. Changes to Terms

12.1 Humbahost may amend these Terms from time to time.
12.2 Updated Terms will be published on our website.
